2. Definitions
- Platform — the FeelIt website, the checkout, the certificate pages and the emails we send about an order.
- Experience Provider (or Provider) — the independent business that creates, operates and delivers an experience.
- Experience — the activity the Provider supplies: a flight, a tasting, a workshop, a ride, and so on.
- Buyer — the person who pays for a booking or a gift certificate.
- Recipient — the person a gift certificate is sent to.
- Attendee — anyone who takes part in the experience, whether or not they bought or received it.
- Gift Certificate (or Certificate) — the record of a gift purchase: the experience, the party size and, where the certificate shows one, the booked date, together with the time where the Provider publishes times.
- Certificate Code — the code printed on the certificate, in the form FEEL-XXXX-XXXX, which is what is used to view, confirm or move the booking.
3. What FeelIt is — and is not
FeelIt is a marketplace. The experiences listed on our site (flights, tastings, workshops, outdoor adventures and others) are created, operated and delivered by independent businesses (“Experience Providers”). When you buy a booking or a gift certificate, FeelIt acts as the Experience Provider’s booking and collecting agent: we market the experience, issue the certificate, collect your payment on the Provider’s behalf and provide first-line support. The contract for the delivery of the experience itself is formed directly between the participant and the Experience Provider. FeelIt does not operate aircraft, venues, ranges, stables or any other facilities, and does not run the activity, set its safety procedures or supply its equipment or staff.
The Provider is an independent business, not us, and not a part of us. You are entitled to know which business you are contracting with before you buy. If the experience page does not name the Provider for the experience you are looking at, write to us and we will tell you who it is — and do not buy until you have that name.
4. Your account and signing in
You can buy as a guest — we create an account for your email address so you can manage your orders. You can sign in through secure links we email you, or set a password in your account. Keep your sign-in details, and any Certificate Codes, confidential: anyone holding a Certificate Code can view the booking it belongs to, confirm attendance in their own name and contact details, and change its date.
5. Prices, payment and taxes
- All prices are in Canadian dollars (CAD).
- Payments are processed by Stripe on its secure hosted page. We never see or store your card number. FeelIt collects the payment on the Experience Provider’s behalf.
- FeelIt adds no charge of its own to the price shown. There is no booking fee, no service fee, and no fee for issuing, sending, activating, changing or holding a certificate. Certificates are digital, so there is nothing to pay for packaging, gift wrapping or delivery. Apart from tax, the price you see is the price you pay.
- Any tax that applies to a booking is charged when you pay — including a booking bought as a gift, which is a booking for a specific date like any other. It is shown as a separate line before you pay and on your receipt. We calculate it for the province in which the experience is delivered, not the province you live in — every experience currently offered on FeelIt is delivered in Alberta. Where a Provider has told us it is a small supplier and has given us no tax registration number, no tax is charged on its experiences, and the checkout says so.
- A certificate that shows no date carries no tax charged at purchase, and we collect none when a date is picked for it: on those certificates the tax on the experience falls due when the certificate is redeemed, and the Experience Provider accounts for it then.
- Extras paid on site. A Provider may charge you directly, at the venue, for optional extras — equipment hire, photographs, gratuities. We do not set, collect or receive those amounts, and we cannot always tell you in advance what they will be.
- You receive an emailed receipt at the time of sale. It repeats the main terms of your purchase — keep it.
6. Gift certificates
- A gift is normally a booked visit. The Buyer chooses the date — and, where the Provider publishes times, the exact time — at checkout, and the certificate shows that booking. Where the Provider publishes times, your seats are held at the Experience Provider from that moment. Where the Provider publishes none, the day is fixed at checkout and the Provider agrees the hour with you afterwards; until they do, no particular time is held for you, and a change of day is arranged by writing to us. How a booking is confirmed and moved is set out in section 7.
- How and when a certificate is delivered. Certificates are delivered electronically, by email, to the address you give us. Nothing is shipped physically. The certificate is issued as soon as your payment is confirmed, and the Buyer decides when it is sent on to the Recipient — you can correct the Recipient’s email address before sending.
- If your certificate does not show a date, it never expires. It was sold on that basis and nothing in these Terms shortens it: the Recipient books whenever they are ready, however long that takes. That is our own promise to the people holding one, and we will keep it — we require the same of every Experience Provider in our agreement with them.
- Certificates are not redeemable or exchangeable for cash and cannot be used to pay a credit account.
- A certificate admits the party stated on it, for the experience stated on it, for one visit. Your booking is in the Provider’s calendar and that is what they check when you arrive; we do not currently mark a certificate as used, so treat the Code as confidential. A certificate is not topped up, and it does not entitle you to swap it for a different experience — but if you would like a different one, write to us and we will see what we can do. Where the Provider cannot deliver the experience at all, the Refund Policy applies.
- The Certificate Code is how the certificate is used. Treat it like cash: we may honour the first use of a code without further identity checks.
- Certificate status can be checked anytime at feelit.ca/activate or by emailing [email protected].
7. Bookings, changes and activation
Where an Experience Provider publishes times, bookings are made against its real availability. Where a Provider publishes none, you choose the day and the Provider confirms the hour with you. Party size limits, minimum ages and other participation requirements are set by the Provider — see section 9.
Changing a booking is never charged for — at any notice level, for anyone. There is no rebooking, change or administration fee, and nothing is deducted from a refund or from what your certificate entitles you to. What can differ is whether the change can be made at all, and how far it can move:
- The Recipient confirms and can move the booking themselves, using the Certificate Code at feelit.ca/activate — no account needed — at least 48 hours before the booked time, to another time the Provider has published within the window described below. Closer than that, a change needs the Provider’s agreement, with the exceptions set out in the Refund Policy, where the change is always granted: write to us and we will arrange it with them.
- If you are the Buyer of a booking for yourself, write to us and we make the change for you. Whether it can be made less than 48 hours before the booked time is the Provider’s call, with the same exceptions set out in the Refund Policy.
- How far ahead a visit can be moved. A booked visit can be moved to any available time up to 90 days after the day the order was paid. Bookings do not travel further than that. If the only times that suit you fall outside that window, tell us and we will refund you instead.
- A certificate that shows no date is booked from scratch, whenever the Recipient is ready; that first booking is not time-limited. Once a date has been picked, the 90-day window above is measured from the day the order was paid, which for such a certificate may already have passed — so the self-service change may show no times, or refuse. That is the window, not our answer: we do not use it to refuse you. Write to us and we will arrange the change with the Provider, or refund you.
- If the Provider cancels, or cannot offer a time that works for you, the Refund Policy gives you a choice: alternative times, or your money back in full.
By confirming or changing a booking through the Platform, the Recipient agrees to these Terms. An Attendee who has not used the Platform is not bound by them. These Terms are an agreement with FeelIt about using the Platform; they are not, and do not replace, any waiver or release the Experience Provider asks an Attendee to sign (see section 9).
8. Cancellations, changes and refunds
Our Refund Policy forms part of these Terms. In short: changing your date is never charged for, at any notice level; at least 48 hours before the booked time, a move to another time the Provider has published within the window in section 7 is granted, and closer than that it needs the Provider’s agreement; if an Experience Provider cannot deliver an experience, you get a full refund; and your statutory rights under the Consumer Protection Act (Alberta) and under the consumer protection law of your own province are always preserved.
9. Safety, risk and participation requirements
Some experiences involve inherent physical risk (for example flying, shooting sports, riding, skydiving). Experience Providers set the safety rules and may require participants to sign their own waiver or release before taking part, to present ID, or to meet age, health, weight or ability requirements. Those requirements are the Provider’s, and a listing states them only where the Provider has written them into the experience description — so if there is any doubt about what applies to your party, ask us before you buy and we will get the answer from the Provider. You are responsible for making sure every Attendee in your party meets the requirements you have been told about.
A Provider’s waiver or release is a document between that Provider and the person signing it, and it will normally also name FeelIt and its people as released parties in respect of the marketing, sale and booking of the experience — we require that in our agreement with the Provider. Read it before you sign it.
If an Attendee is turned away for not meeting one of the Provider’s requirements, we will ask the Provider to rebook where they can. Whether a refund is available depends on the Provider’s rules and on your statutory rights, which nothing in these Terms limits.
10. Our responsibility to you
We stand behind the platform: certificate issuance, payment processing, activation and the accuracy of what we control. To the maximum extent permitted by applicable law: (a) FeelIt is not responsible for the acts or omissions of Experience Providers in delivering the experiences; and (b) FeelIt’s total liability in connection with a purchase is limited to the amount paid for that purchase. That limit does not apply to death or personal injury.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Consumer Protection Act (Alberta), under the consumer protection law of your province of residence or any other applicable consumer protection legislation, or any liability that cannot be excluded or limited under applicable law. Any attempt to do so has no effect.
11. Your statutory cancellation rights
Alberta’s Internet Sales Contract Regulation applies to our online sales over $50, because we are an Alberta supplier. It gives consumers cancellation rights in certain circumstances — for example, if required pre-purchase information was not disclosed, or a copy of the contract was not provided within 15 days.
- If the experience does not begin when it should, you can cancel at any time before it begins and we return everything you paid. Where no date was set — and a certificate that shows no date is exactly that case — the Regulation gives you that right once 30 days have passed since your purchase, so waiting because you choose to costs you nothing. Where a date was set, we honour the same right from that date, without asking you to wait out any further period.
- You can give us a cancellation notice in any way and by any means: the law does not require a particular form, a particular address or a particular channel. Email or post reach us fastest. Unless you hand it to us in person, the notice counts from the moment you send it.
- Where a statutory cancellation right is exercised, we refund all consideration paid within 15 days of the cancellation, as the Regulation requires — including amounts you paid to someone else in connection with the purchase. That 15-day deadline is the one the Regulation sets, and we apply it to any statutory cancellation, whatever the purchase price.
- If you live outside Alberta, the consumer protection law of your own province may give you further rights. Those rights apply whether or not you invoke them; tell us and we will act on them. Nothing here replaces them.
12. Reviews and content
If you post a review or other content, it must reflect your genuine experience. Disclose any material connection to the Experience Provider — for example, if you work for them, are related to someone who does, or received a discount in exchange for the review. You grant FeelIt a non-exclusive licence to display the content on the marketplace.
Our side of it: we publish reviews as their authors wrote them. We do not edit, shorten or rephrase a review without the author’s written permission. We remove content that is unlawful, fake, or unrelated to a real purchase — we do not remove a review because it is critical of a Provider or of us.
13. Intellectual property and copyright complaints
The FeelIt word mark and logo are used as our trademarks — see the notice in section 1 — and the material we produce for the site is ours. Listing photographs and descriptions come from the Experience Provider, who grants us a written licence to them in our vendor agreement and warrants that it holds the rights it licenses. Nothing on the site may be copied for commercial use without permission.
If you believe material on feelit.ca infringes your copyright, email [email protected] with the subject line Copyright concern. Under section 41.25(2) of the Copyright Act, your notice has to be in writing and state:
- your name and address;
- the work or other subject-matter you say is infringed;
- your interest or right in it;
- the exact location of the material on our site (a link);
- what the alleged infringement is;
- the date and time of the alleged infringement;
- and anything else the regulations require.
Your notice must not contain an offer to settle the claimed infringement, a request or demand for payment or for personal information, or any reference to one, including a link. The Copyright Act forbids it, and a notice containing them does not oblige anyone to forward it.
When we get a notice that meets those requirements, we forward it to whoever supplied the material as soon as feasible, tell you that we have done so — or why it was not possible — and keep records that would allow that person to be identified. That is how we handle notices. To be straight with you: Canada’s regime is notice-and-notice, and it does not require material to be taken down on receipt of a notice, so we do not promise removal. We may remove material that breaks these Terms or that a court tells us to remove.
14. Acceptable use
- No fraudulent purchases, invalid payment methods or abuse of Certificate Codes.
- No scraping, resale or commercial exploitation of the marketplace without our consent.
- No interfering with the operation or security of the site.
15. Privacy
How we handle personal information — including the Recipient’s details a Buyer shares with us — is described in our Privacy Policy.
16. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows the current version.
- The terms of your purchase are fixed on the day you buy. What you bought, what you paid, and how it can be changed or refunded are governed by the version in force that day, and a later change never takes anything away from them. Where a later version gives you more than the version in force that day, the later version applies.
- A material change to how the Platform is used takes effect no earlier than 30 days after it is posted here, and we will email certificate holders before it takes effect.
- We keep previous versions of these Terms. Ask us and we will send you the version in force on the day of your purchase, from the history we keep.
- Our Refund Policy forms part of these Terms, so this section applies to changes in it in exactly the same way.
17. Governing law and where disputes go
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. Disputes may be brought before the courts of Alberta, subject to any right you may have under applicable consumer protection law to bring proceedings in another forum — for instance, in the province where you live.
These Terms contain no arbitration clause. We are not asking you to give up going to court, and we are not sending you to a private process that would cost you more than the purchase.
